Terms of Service

These Terms of Service apply to services offered under the Marrakech Builders brand through marrakechbuilders.com and through quotations, messages, emails or other communications issued in connection with Marrakech Builders.

Marrakech Builders is a commercial brand operated by VeriHome. VeriHome is the contracting and billing entity for services provided under the Marrakech Builders brand.

By accepting a quotation, authorising works, paying a deposit or otherwise instructing Marrakech Builders to commence work, the Client accepts these Terms of Service.

1. Services

Marrakech Builders provides building repair, maintenance, corrective works and renovation services, including, where applicable:

  • Waterproofing and leak repairs
  • Roof and terrace repairs
  • Damp and moisture-related corrective works
  • Crack, masonry and render repairs
  • Plumbing repairs
  • Electrical repairs
  • Pool repairs and waterproofing
  • Tiling, plastering, tadelakt and finish repairs
  • General property repairs and maintenance
  • Riad and villa renovation works

The exact scope of each project is defined by the written quotation or other written agreement issued to the Client.

Any work not expressly included in the agreed scope is excluded unless subsequently approved as a variation.

2. Site Visit and Assessment

Quotations are normally prepared following an on-site visit and assessment of the property.

Marrakech Builders may decline to provide a firm quotation solely from photographs, videos, plans, telephone descriptions or third-party information.

The Client, or a person authorised to make decisions on the Client’s behalf, should be available during the initial site visit where reasonably required.

Assessments are generally visual and non-destructive unless otherwise agreed.

Conditions concealed behind walls, floors, ceilings, waterproofing systems, finishes, built-in installations or other inaccessible areas cannot normally be identified until work begins.

3. Quotations

Quotations are based on:

  • the visible condition of the property at the time of inspection;
  • information supplied by the Client;
  • accessible areas of the property;
  • the agreed scope of work; and
  • reasonably foreseeable site conditions.

Unless expressly stated otherwise, a quotation does not include work resulting from concealed defects, previously undocumented construction, inaccessible installations or conditions that could not reasonably have been identified before work commenced.

Quotations remain valid for [30 days] unless another validity period is stated in writing.

Changes in material prices, taxes, government charges or other costs occurring after the validity period may require the quotation to be revised.

4. Hidden and Unforeseen Conditions

Repair and renovation work may expose conditions that were not visible before work began.

Examples include:

  • concealed water damage;
  • deteriorated substrates;
  • defective historic repairs;
  • damaged plumbing or drainage;
  • unsafe electrical installations;
  • insufficient structural support;
  • failed waterproofing beneath finishes;
  • corrosion;
  • voids or poorly bonded render;
  • damaged timber;
  • undocumented pipework or cabling; and
  • construction that differs from available plans or information.

Where unforeseen conditions materially affect the agreed work, Marrakech Builders will inform the Client and, where appropriate, provide a variation or additional quotation before carrying out substantial additional works.

Emergency work necessary to prevent immediate damage or create a safe working condition may be carried out where reasonably necessary.

5. Variations and Additional Work

Any addition, omission or alteration requested after the quotation has been accepted may constitute a variation.

Variations may affect:

  • price;
  • materials;
  • completion time;
  • labour requirements; and
  • sequencing of the project.

Where practical, variations will be confirmed in writing before the additional work is carried out.

Messages exchanged through WhatsApp, email or other written communication may constitute written approval of a variation.

6. Deposits and Payment

Payment terms will be stated in the relevant quotation or invoice.

Unless expressly agreed otherwise, Marrakech Builders may require a deposit before purchasing materials, reserving labour or commencing works.

The Client must make payments according to the agreed payment schedule.

Marrakech Builders may suspend works where an agreed payment becomes overdue.

Any resulting delay to the project schedule will not be considered a delay caused by Marrakech Builders.

Final payment becomes due in accordance with the quotation or invoice and is not dependent upon unrelated works being performed by other contractors.

All invoices and payment requests relating to Marrakech Builders are issued by VeriHome, unless expressly stated otherwise.

7. Materials

Materials will be selected according to the quotation, specification or subsequent agreement with the Client.

Natural materials, handmade finishes, tiles, stone, timber, tadelakt and similar products may exhibit normal variations in colour, texture, dimensions or appearance.

Exact colour or texture matching between existing and new materials cannot always be guaranteed, particularly on older properties.

Where an original material is unavailable, Marrakech Builders may propose the closest reasonably available alternative for Client approval.

8. Client-Supplied Materials

Where the Client supplies materials, fixtures, fittings, appliances or equipment, Marrakech Builders is not responsible for:

  • manufacturing defects;
  • incorrect dimensions;
  • incompatibility;
  • missing components;
  • delivery delays;
  • damage occurring before delivery to Marrakech Builders;
  • insufficient quantities; or
  • warranties provided by the manufacturer or supplier.

Additional labour caused by unsuitable or defective Client-supplied materials may be charged separately.

9. Access to the Property

The Client must provide reasonable access to the property during the agreed working period.

This includes, where applicable:

  • keys or access permissions;
  • functioning electricity and water;
  • access to relevant rooms, roofs, terraces, technical areas and exterior spaces;
  • permission to move or protect furniture where required; and
  • cooperation from building management, guards, neighbours or other persons controlling access.

Delays caused by lack of access may extend the project schedule and may result in additional costs.

10. Furniture, Belongings and Occupied Properties

The Client should remove or adequately secure valuable, fragile or sensitive belongings from work areas before works commence.

Marrakech Builders will take reasonable precautions to protect the property but construction and repair work may involve dust, vibration, noise and temporary disruption.

Unless specifically included in the quotation, Marrakech Builders is not responsible for storage, removal or relocation of the Client’s belongings.

11. Existing Installations and Defects

Marrakech Builders is responsible for the work it has agreed to perform.

It is not responsible for defects in existing parts of the building or installations outside the agreed scope.

Repair work may reveal or interact with pre-existing defects.

For example, opening a wall to repair a leak may reveal damaged plaster, corroded pipework, unsuitable electrical wiring or other deterioration requiring additional work.

Marrakech Builders will not be liable for failure of an existing system merely because work was undertaken nearby, unless that failure was directly caused by negligent work performed by Marrakech Builders.

12. Waterproofing and Moisture Repairs

Moisture problems can have more than one source.

Where Marrakech Builders carries out waterproofing, leak or damp-related works, the agreed repair will address the defect or source identified within the agreed scope.

The presence of later moisture does not automatically establish failure of the repair where the moisture originates from another source, including plumbing leaks, neighbouring properties, ground moisture, condensation, drainage defects or other parts of the building.

The Client must inform Marrakech Builders promptly if signs of recurring moisture are observed after completion so that the area can be assessed.

13. Cracks and Structural Conditions

Repair of a crack does not constitute a structural engineering certification unless engineering services are expressly included.

Some cracks may result from settlement, movement, thermal expansion, material shrinkage, structural movement or other causes.

Where Marrakech Builders considers specialist structural input appropriate, the Client may be advised to obtain an assessment from an engineer or other competent professional.

Marrakech Builders does not act as a bureau de contrôle, structural engineering practice or statutory certification authority unless expressly stated otherwise.

14. Electrical and Plumbing Work

Certain works may require specialist trades.

Electrical and plumbing repairs are carried out within the agreed scope and based on accessible installations.

Existing installations may contain defects, alterations or non-compliant work not visible before work begins.

Where unsafe or materially defective conditions are discovered, additional corrective work may be recommended.

15. Programme and Completion Dates

Any stated start or completion date is an estimate unless expressly agreed in writing as a fixed contractual date.

Construction and repair schedules may be affected by circumstances including:

  • hidden defects;
  • Client-requested changes;
  • material availability;
  • supplier delays;
  • weather;
  • drying or curing times;
  • access restrictions;
  • third-party contractors;
  • utility interruptions;
  • administrative restrictions; and
  • circumstances beyond Marrakech Builders’ reasonable control.

Marrakech Builders will make reasonable efforts to keep the Client informed of material changes to the programme.

16. Third-Party Contractors and Specialists

Where appropriate, Marrakech Builders may coordinate or engage specialist trades, subcontractors or suppliers in connection with the project.

Where a specialist is contracted directly by the Client, Marrakech Builders is not responsible for that specialist’s work, delays, errors or omissions.

Where another contractor performs work that affects Marrakech Builders’ completed work, any resulting damage or defect is excluded from Marrakech Builders’ responsibility.

17. Client-Appointed Professionals

Architects, engineers, interior designers, property managers and other professionals may provide instructions affecting the project.

The Client is responsible for ensuring that persons authorised to issue instructions on the Client’s behalf are clearly identified.

Where instructions from the Client and another appointed representative conflict, Marrakech Builders may suspend the affected work until written clarification is received.

18. Permissions and Approvals

Unless expressly included in the quotation, the Client is responsible for obtaining any required:

  • planning permissions;
  • condominium or syndic approvals;
  • neighbour permissions;
  • heritage approvals;
  • administrative authorisations; or
  • other permissions required for the works.

Marrakech Builders may assist with administrative or professional coordination where separately agreed.

19. Photographs and Documentation

Marrakech Builders may photograph work areas for:

  • project records;
  • progress monitoring;
  • technical documentation; and
  • verification of completed work.

Photographs identifying the property or Client will not be used publicly for marketing without appropriate permission.

20. Workmanship and Defects

Marrakech Builders will carry out agreed works with reasonable care and skill consistent with the nature of the work.

If the Client believes there is a defect attributable to Marrakech Builders’ workmanship, the Client should notify Marrakech Builders promptly and provide reasonable access to inspect the issue.

Where a defect is confirmed to result from Marrakech Builders’ workmanship, Marrakech Builders will have a reasonable opportunity to rectify the affected work before the Client appoints another contractor and seeks recovery of costs.

This does not cover deterioration or damage caused by:

  • normal wear;
  • misuse;
  • lack of maintenance;
  • movement of the existing building;
  • leaks or defects outside the repaired area;
  • work by others;
  • modifications after completion;
  • abnormal weather or flooding;
  • underlying defects outside the agreed scope; or
  • materials supplied by the Client.

21. Finishes and Cosmetic Appearance

Repair work frequently involves blending new work into existing finishes.

Exact matching of existing:

  • paint;
  • plaster;
  • tadelakt;
  • tiles;
  • grout;
  • stone;
  • timber;
  • render; or
  • aged finishes

cannot always be guaranteed.

22. Suspension or Termination of Works

Marrakech Builders may suspend or terminate works where:

  • payment is materially overdue;
  • the site becomes unsafe;
  • reasonable access is denied;
  • the Client repeatedly prevents the agreed works from proceeding;
  • the Client requests unlawful or unsafe work; or
  • another serious contractual breach occurs.

The Client remains responsible for payment for work performed, materials ordered and reasonable costs incurred up to the date of suspension or termination.

23. Limitation of Responsibility

Marrakech Builders is responsible for loss or damage directly resulting from negligent performance of the agreed works.

To the extent permitted by applicable law, Marrakech Builders is not responsible for indirect, consequential or speculative losses, including loss of rental income, loss of profit, loss of opportunity or reduction in property value, except where such limitation is prohibited by law.

Nothing in these Terms excludes liability that cannot legally be excluded.

24. Client Information

The Client is responsible for providing accurate information relevant to the works, including known defects, previous repairs, property restrictions and any documentation reasonably required.

Marrakech Builders is not responsible for consequences arising from material information withheld or incorrectly supplied by the Client or third parties.

25. Communication

The parties may communicate through:

  • email;
  • telephone;
  • WhatsApp;
  • written quotation;
  • invoice; or
  • other agreed written communication.

Instructions, approvals and variations confirmed through WhatsApp or email may be relied upon as written Client instructions.

26. Complaints

Any concern regarding the works should be raised with Marrakech Builders as soon as reasonably possible.

The Client should allow Marrakech Builders reasonable access and opportunity to inspect and, where appropriate, correct the issue before appointing another contractor to undertake remedial work.

27. Privacy

Personal information collected through the website, quotations, communications and project administration will be handled in accordance with the Marrakech Builders Privacy Policy.

28. Governing Law

These Terms and any services provided by VeriHome under the Marrakech Builders brand are governed by the laws of the Kingdom of Morocco.

Any dispute that cannot be resolved amicably will be subject to the jurisdiction of the competent Moroccan courts, subject to any mandatory consumer protection provisions that may apply.
